Terms of Service

These terms set out the rules for using Dailies, including optional purchases, Apple services, local data, and private iCloud sync.

1. Agreement

These Terms of Service (“Terms”) apply to your use of the Dailies app, its Apple Watch app and widgets, and the website at trydailies.app (together, the “Service”). By downloading, accessing, purchasing, or using the Service, you agree to these Terms and the Privacy Policy.

If you do not agree, do not use the Service. If you are not old enough to enter into this agreement where you live, you may use Dailies only with the permission and supervision of a parent or legal guardian.

2. What Dailies provides

Dailies is a personal daily-life management tool for routines, reminders, meals, shopping, notes, events, wellbeing logs, personal finance planning, and related features. Features may vary by device, operating system, region, permission settings, purchase status, and app version.

3. Your licence to use the app

Subject to these Terms and the App Store Usage Rules, we grant you a personal, limited, non-exclusive, non-transferable, and revocable licence to use Dailies on Apple-branded devices that you own or control.

The app is licensed, not sold. Apple’s standard Licensed Application End User License Agreement also applies except where these Terms provide valid additional terms. Apple is not responsible for providing maintenance or support for Dailies.

4. Your responsibilities

You are responsible for:

  • the information you enter, import, store, export, or share using Dailies;
  • checking reminders, calculations, dates, health entries, financial figures, and imported information before relying on them;
  • maintaining appropriate device security, backups, Apple ID access, and available iCloud storage; and
  • using the Service lawfully and respecting the rights of others.

You must not interfere with the Service, bypass purchase or security controls, distribute unlawful or infringing material, or reverse engineer the app except to the extent such a restriction is prohibited by law.

5. Local data, iCloud, and backups

Dailies stores data locally by default. Optional Dailies+ sync uses Apple CloudKit and depends on your Apple ID, iCloud availability, network connection, device settings, and Apple services. Some categories remain local as described in the Privacy Policy.

You should keep suitable device or exported backups. Sync is a continuity feature and is not a guarantee against deletion, corruption, account loss, device loss, software defects, or service interruption. You are responsible for reviewing exported files and storing them securely.

6. Purchases and subscriptions

Dailies may offer one-time purchases and automatically renewing subscriptions, including Dailies+. Prices, billing periods, trial terms, included features, and local taxes are shown by Apple before purchase and may vary by region.

Payment is charged to your Apple account. A subscription renews automatically unless you cancel it through your Apple account at least 24 hours before the end of the current billing period, subject to Apple’s current rules. You can manage or cancel subscriptions in Apple account settings. Refunds and billing disputes are handled by Apple under App Store policies and applicable law.

When a paid entitlement ends, paid features may become unavailable. Your locally stored data remains subject to the app’s available read, export, and management controls. Dailies will not deliberately hold your core local data hostage to a subscription.

7. Health and wellbeing information

Dailies is not a medical device and does not provide medical advice, diagnosis, treatment, emergency monitoring, or medication assurance. Health, hydration, caffeine, weight, step, and medication-related features are for personal organisation and general information only. Do not rely on Dailies for an emergency or as the sole reminder for critical care. Seek advice from a qualified professional for medical concerns.

8. Financial information

Finance features are personal planning tools, not financial, tax, accounting, credit, or investment advice. Calculations and reminders may be incomplete or inaccurate and do not replace statements from your bank, lender, employer, merchant, or adviser. You remain responsible for payments, filings, and financial decisions.

9. Apple and other external services

Dailies can interact with services provided by Apple, including the App Store, iCloud, HealthKit, EventKit, Contacts, Photos, notifications, widgets, and Watch connectivity. Those services are governed by Apple’s terms and policies and may change or become unavailable. Links or exports may also open third-party apps or services that we do not control. Your use of them is at your own discretion and subject to their terms.

10. Ownership

Dailies, including its software, design, branding, text, and other materials, is owned by or licensed to us and is protected by applicable intellectual property laws. You retain ownership of the content you create in Dailies. You grant us no right to use that content except as technically necessary to provide a feature you deliberately invoke.

11. Availability and changes

We may fix, update, add, remove, or change features to maintain the Service, respond to platform or legal requirements, improve reliability, or develop the product. We do not promise that every feature will always be available or compatible with every device. Where practical, material changes affecting paid functionality will be communicated through the app, website, or App Store information.

12. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available”. We disclaim implied warranties of merchantability, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or immune from data loss. Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded.

13. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive loss, or for loss of data, profits, opportunity, goodwill, or business arising from use of or inability to use the Service.

Our total liability relating to the Service will not exceed the amount you paid for Dailies in the 12 months before the event giving rise to the claim. This limitation does not apply where liability cannot lawfully be limited, including liability for fraud, wilful misconduct, death or personal injury caused by negligence, or mandatory consumer protections.

14. Suspension and termination

You may stop using Dailies at any time. Your licence ends if you materially breach these Terms. We may also discontinue the Service, subject to applicable law and App Store obligations. Provisions that by their nature should survive termination, including ownership, disclaimers, liability limits, and dispute provisions, will survive.

15. Governing terms and consumer rights

These Terms are governed by the laws applicable where the provider of Dailies is established, without regard to conflict-of-law rules. If you are a consumer, you keep any mandatory protections and rights to bring a claim in the courts available to you under the law of the country where you live. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

16. Changes to these Terms

We may update these Terms to reflect changes to Dailies, Apple platform requirements, or the law. The revised Terms will be published here with a new effective date. If a change materially affects your rights, we will take reasonable steps to provide additional notice. Continuing to use Dailies after the revised Terms take effect means you accept them, where permitted by law.
